EMLF Coal Law Short Course – August 2-6, 2009
Watch for details on this comprehensive course to be taught at the Radisson Waterfront Place Hotel and the West Virginia University College of Law in Morgantown, WV.
This Coal Law Short Course is designed to give lawyers who are new to the practice of coal and energy law the tools to handle issues arising in both litigation and transactional settings. While the lawyer in practice 0-5 years will benefit from this short course, engineers, business persons and seasoned lawyers desiring a better understanding of the laws and regulation of coal will find the program invaluable.
The course begins Sunday evening, August 2 with a dinner at the Radisson Waterfront Place Hotel, followed by presentations on geology and an introduction to mining techniques.
The course moves to the law school Monday through Wednesday with the following sessions: Ownership Determination and Resolving Ambiguities; Mining Rights and Easements; Surface Support and Subsidence; Conflicts; Trespass and Damage Claims; Statutory Actions and Protections; Divided Ownership and Adverse Possession; The Coal Lease, Post Lease Conveyances and Termination; The Surface Mining Control and Reclamation Act of 1977 (SCMRA); Clean Water Act and Amendments; Clean Air Act; Other Regulatory Programs Affecting Coal Mining; Mine Safety & Health Law; Black Lung (Coal Worker’s Pneumoconiosis) and State Workers’ Compensation; The Business of Coal Mining; Labor: Union Free and Union Operations; and Contractor Issues & Employment.
The classroom sessions end Wednesday afternoon with a case study of a Coal Asset-Based Transaction, the theme of which will be woven through the daily classroom experience so attendees can learn how all the pieces fit together. On Thursday, there will be an optional tour of a coal mining operation and preparation plant.
Course coordinator is Stephen G. Allen, Stites & Harbison, Lexington, KY.

The family of Mary Sue Schulberg is deeply appreciative of the generosity of her friends and colleagues in the mineral industry. Gifts can still be made in care of the EMLF at 340 South Broadway, Suite 101, Lexington, KY 40508.
