ESG Trends and Developments: How the SEC and Other Federal Agencies Have Stepped Up ESG and ESH Regulations in 2022 is sponsored by Reed Smith and will focus on selected ESG developments that impact natural resource and energy companies. SEC Focus: Security Exchange Commission Draft Regulation re: Climate Change Disclosure Requirements – “why both public and private companies need to take interest.” The SEC’s recent proposed regulation requiring heightened disclosure of greenhouse gas emissions is intended to create more transparency, allowing investors to make more informed decisions about companies whose operations and products are linked to global warming. This section of the program summarizes the proposed regulation, including how regulated parties would need to report on “Scope 3 emissions” from their suppliers and customers. We will also look at how these monitoring and reporting obligations can be transferred from directly regulated (publicly traded) corporations to their privately held commercial counterparties.
2. Environmental, Health, and Safety Regulatory and Enforcement Focus
• EPA’s renewed efforts to overhaul the Risk Management Program rule
• The Worker Endangerment Initiative: a collaboration between OSHA, EPA, and the DOJ
